Our store is hosted on Shopify Inc., which provides us with the e-commerce platform to sell our products to you.

FLUR glassware is made from double-walled borosilicate glass, one of the most durable types of glass available. While borosilicate is more resistant to thermal shock than standard glass, it is still glass — and all glass products carry inherent risks. These risks exist regardless of the quality of manufacturing and are inherent to all glass products.

By purchasing, receiving, or using any FLUR product, you accept and assume all risks associated with the use of glass products, including but not limited to the risk of breakage, cuts, lacerations, burns from hot contents, or ingestion of glass fragments. This assumption of risk applies whether the breakage or injury results from normal use, misuse, product characteristics, manufacturing variations, or any other cause. E & R Media LLC (d/b/a FLUR Glassware), its owners, officers, members, employees, and affiliates shall not be held liable for any injury, illness, loss, or damage — whether direct, indirect, incidental, or consequential — arising from the use or inability to use our products. This limitation of liability applies to the fullest extent permitted by applicable law.

Any person who uses a FLUR product — whether they purchased it directly, received it as a gift, or otherwise came into possession of it — is bound by and subject to this assumption of risk and limitation of liability.

FLUR glassware is designed for personal, household use with standard hot and cold beverages. Use outside of intended purpose — including commercial use or use by unsupervised children — falls outside the scope of our product guidelines and warranty.

Section 3 — Warranty Policy

All FLUR glassware includes a 1-year warranty from the date of purchase covering manufacturer defects (limited to double-walled seal damage) and one instance of accidental damage per set. Warranty replacements are limited to the same glass in the same size — no color or size substitutions. Warranty coverage applies to personal, household use only and does not extend to commercial use.

The warranty replacement described above constitutes your sole and exclusive remedy for any product defect, breakage, or product-related claim of any kind. By making a purchase, you acknowledge and agree that this warranty is provided in lieu of all other remedies, and that no other obligation or liability exists on the part of E & R Media LLC (d/b/a FLUR Glassware) beyond what is expressly stated in this warranty.

All product descriptions and pricing are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear to be placed by dealers, resellers, or distributors. If we cancel an order, we may attempt to notify you using the contact information provided at the time of purchase.

In no case shall E & R Media LLC (d/b/a FLUR Glassware), its owners, officers, members, employees, affiliates, agents, contractors, suppliers, or service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind — including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages — whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of our services or any products purchased through our site, even if advised of their possibility.

To the extent that any limitation of liability set forth herein is found to be unenforceable, the total liability of E & R Media LLC (d/b/a FLUR Glassware) for any claim arising from or related to our products or services shall not exceed the original purchase price paid by you for the specific product giving rise to the claim.

Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless E & R Media LLC (d/b/a FLUR Glassware) and its owners, officers, members, employees, affiliates, agents, contractors, and suppliers from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, or your violation of any law or the rights of a third party.

Section 16 — Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms, our products, or our services shall first be resolved through good-faith informal negotiation. You agree to contact us at support@flurglassware.com before initiating any formal legal proceeding, and to allow thirty (30) days for resolution.

If informal resolution is unsuccessful, any remaining dispute shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in Milwaukee County, Wisconsin. The arbitration shall be conducted by a single arbitrator, and the arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court having jurisdiction.

You agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against E & R Media LLC (d/b/a FLUR Glassware).

Section 17 — Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. This determination shall not affect the validity and enforceability of any remaining provisions.
